1. Acceptance and eligibility
By creating an account or using MomentBeam, you agree to these terms and the Privacy Notice. You must be at least 18 years old and able to enter into a binding agreement. If you use MomentBeam for another person or organization, you represent that you are authorized to accept these terms for them.
2. The service and the Roku app
MomentBeam lets authorized people collect, arrange, moderate, and privately display photos on connected screens. The Roku app is a free companion display app. It requires internet access, an eligible MomentBeam wall, and an active web subscription or other entitlement supplied through MomentBeam. No subscription or purchase is sold inside the Roku app.
3. Accounts, displays, and guest links
Keep access to your email and devices secure and promptly revoke access you no longer recognize. You are responsible for activity under your account and for choosing who may administer a wall. Guest contribution links are limited capabilities: share them only with intended contributors and disable them when they are no longer needed.
4. Your content and permissions
You keep ownership of content you submit. You give MomentBeam a limited, worldwide license to host, copy, process, resize, arrange, transmit, and display that content only as needed to provide, secure, and improve the service. This license ends when the content is deleted, subject to reasonable technical, backup, legal, and security retention.
You must have the rights and permissions needed for every photo and caption you submit, including appropriate permission for images of children or other people. Guest contributions may be reviewed, rejected, archived, or removed by authorized wall managers.
5. Acceptable use
Do not use MomentBeam to:
- break the law, infringe rights, harass, exploit, or harm another person;
- upload malware or content you are not authorized to use;
- bypass access controls, probe another user's data, or disrupt the service;
- misrepresent your identity or use contribution links for unsolicited messages; or
- resell or reverse engineer the service except where applicable law permits it.
We may restrict or suspend access when reasonably necessary to address these risks.
6. Subscriptions and changes
Subscription prices, billing periods, trials, taxes, cancellation terms, and renewal information are shown before purchase on the web. The billing provider's terms may also apply. You can manage an eligible subscription through the web account that purchased it. MomentBeam may change or discontinue features, but we will provide notice when required.
7. Availability and disclaimers
The service is provided on an “as available” basis. Networks, televisions, providers, and user content can affect quality and availability. To the maximum extent permitted by law, MomentBeam disclaims implied warranties, including merchantability, fitness for a particular purpose, and non-infringement. Nothing in these terms limits rights that cannot legally be limited.
8. Liability
To the maximum extent permitted by law, MomentBeam and its operator will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost data, revenue, profits, or goodwill arising from the service. Any aggregate liability will not exceed the amount you paid for MomentBeam during the six months before the event giving rise to the claim. These limits do not apply where prohibited by law.
9. Ending use, updates, and contact
You may stop using MomentBeam at any time and may request workspace deletion through the account tools. We may terminate access for a material or repeated violation, subject to applicable law. If these terms change, we will update the effective date and provide additional notice when required.
